Roll Call – Councilor Graney, McNabb, Smith, Brower and Mayor Quill – Present

Staff – Mark Palesh, City Manager, Debra McCormick, City Clerk, John Rossi, Corporation Counsel, Lisa Green, Comptroller, Mike Hammon, Fire Chief, Gary Giannotta, Police Chief, Karen Green, Human Resource Director.

Pledge of Allegiance to the Flag – All stood for the Pledge of Allegiance.

Moment of Silent Prayer or Reflection – Mayor Quill asked everyone to remain standing for a moment of silent prayer or reflection

PUBLIC HEARING – LOCAL LAW #2 OF 2008
Mayor Quill opened the Public Hearing regarding Local Law #2 of 2008 amending Local Law #2 of 2007 establishing residency and proximity restrictions in the City of Auburn for Level III Sex Offenders.  He invited anyone wishing to speak to come forward.  There were no speakers. Mayor Quill moved to the public to be heard portion of the meeting and stated he would keep the Public Hearing open until the vote later in the meeting.
Public to be Heard – Dom Ciampaglia~116 Lake Ave. – spoke to Council regarding recent changes to procedures and prices at the landfill.  He asked Council to take a second look at the changes as they affect responsible homeowners.  Mayor Quill asked the Manager to contact Mr. Ciampaglia to discuss his concerns.

Councilor McNabb motioned for adjournment to executive session to discuss the employment history of a particular individual, seconded by Councilor Graney.  Council voted unanimously to adjourn at 6:10PM Council returned at 7:00PM.  Mayor Quill called the meeting back to order.

City Manager’s Report
Mr. Palesh reported the following:
·       East Genesee St. construction has begun again.
·       Amawalk Consultants will present a water and sewer update to Council on March 27th.  
·       The Chamber of Commerce will be hosting the State of the City/County luncheon on March 27th.  He will join County Manager Wayne Allen in presenting each municipality’s state.  

Report of City Officials – Mayor Quill reported that his office has received several phone calls from the Governor’s office.  He spoke with several staff members that he has met over the last few months and was reassured that the recent resignation of Governor Spitzer would not effect the relationship that Auburn and the Governor’s office have established.

Committee Reports - None

Mayor Quill asked for and received Council consensus to add item 12 c. to the agenda.

Presentation of Petition and Communications     - The Clerk read.

Ordinances  

Ordinance #1 of 2008 authorizing amendment to the Auburn Municipal Code of the City of Auburn, New York, Chapter 104, Article II entitled “Animals”.  Vote: Councilor Graney and Councilor McNabb, no. Councilors Smith, Brower, and Mayor Quill, aye.  CARRIED

Resolutions  

Appointment Resolution #22 of 2008 authorizing appointment to the Board of Assessment Review.  Motion to Table to clarify information.  Graney/McNabb.  Vote: Councilor Graney, McNabb, Smith, Brower, and Mayor Quill, aye.  TABLED.

Agreement Resolution #23 of 2008 authorizing amendment to contract with Marcy Construction.  Vote: Councilor Graney, McNabb, Smith, Brower, and Mayor Quill, aye.  CARRIED.

Appointment Resolution #19 of 2008 appointing Gwen Jones, 48 Boyle Ave., Demetrius Murphy, 25 Bradford St., Fred Richardson, 10 Boyle Ave, and Joe Leogrande, 161 East Genesee St. to the Auburn Human Rights office.  Vote: Councilor Graney, McNabb, aye, Councilor Smith, no, Councilor Brower, and Mayor Quill, aye.  CARRIED.

Local Law  
Mayor Quill closed the Public Hearing.

Tabled Legislation - None

Other Business – Councilor Smith thanked Public Works Director Jerry DelFavero and his staff for taking care of graffiti that needed to be removed.
